Q 14-1、What are the times when drug users enter rehab, rehab institution, and prison?

A:

  • Timing of entering the rehab:
    • First-time drug users.
    • Those who re-administer drugs after 3 years of rehabilitation or abstention compulsory abstention.
  • Timing of entering the rehab institution:Observation or rehab people have a tendency to continue to use drugs.
  • Timing of entering prison:Those who re-administer drugs within 3 years after the observation or abstention compulsory abstention.

Q 14-2、Where will the observation or rehab people execute observation?

A:

The drug abuser treatment center (Sindian, Taichung, Kaohsiung, Taichung Women's and Kaohsiung Women's), detention centers (Taipei Women's, Taitung, Hualien, Penghu, and Kinmen) and Juvenile Detention House (Taipei, Tainan and Kaohsiung) designated as a place of observation. The court and the prosecutor's office will send the observation or rehab person to the observation place or temporarily house in the original observation place. And within a week, the inmate will be sent to a special observation place for execution.

Q 14-3、How long does it take to observation and abstention compulsory abstention?

A:

  • The period of observation shall not exceed two months. The period of abstention compulsory abstention shall not exceed six months. Until there is no need for abstention compulsory abstention, but the longest cannot exceed one year.
  • The rehab shall observe the situation of the person under observation, and after the doctor has determined that there is no tendency to continue to use drugs, the agency shall report to the prosecutor to stop the punishment.
  • Six months after the observation or rehab people received the treatment. After evaluation, if there is no need for abstention compulsory abstention, the evidence required for abstinence should be submitted to the prosecutor and the court to stop.
  • Family members cannot apply to the prosecutor for cessation of observation or abstention compulsory abstention.

Q 14-4、How to calculate and pay the observation fee?

A:

  • The daily fee per person is as follows:
    • Meal expenses:
      • Adults under observation or rehab are NT$67 per day per person (the same below) (NT$78 in Penghu, Kinmen, and Lyudao areas, NT$107 in Matsu areas).
      • Juveniles under observation or rehab are NT$90 per day per person (NT$90 in Penghu, Kinmen, and Lyudao areas, NT$107 in Matsu areas).
    • Drug material fee:NT$33 per day per person.
    • Urine screening material fee:NT$200 per person per time.
    • Medical fees:NT$40 per day per person.
    • Other: Based on actual demand expenditures.
  • Circumstances in which observation fees are exempt:
    • Surrender:According to the content of the ruling.
    • Poor:During the period of observation, reminder, or notification of payment, documents to prove that poverty is unable to afford. (Proof of low-income households) You can apply for exemption for unpaid fees; however, the paid part will not be refunded.
  • Payment method:
    • After releasing:Family members or observation people can go to the General Affairs Section of the agency to pay or use the transfer. When making a transfer, please indicate the name and ID number of the observation person.
    • During observation:In addition to withholding fees from the custody, if you want to pay the fees first, you can indicate in writing. The agency will handle fee collection operations in accordance with procedures.

Q 14-5、How to calculate and pay the cost of abstention compulsory abstention

A:

  • The daily fee per person is as follows:
    • Meal expenses:
      • Adults under abstention compulsory abstention are NT$67 per day per person (the same below) (NT$78 in Penghu, Kinmen, and Lyudao areas, NT$107 in Matsu areas).
      • Juveniles under abstention compulsory abstention are NT$90 per day per person (NT$90 in Penghu, Kinmen, and Lyudao areas, NT$107 in Matsu areas).
    • Course fee:NT$30 per day per person.
    • Teaching material compilation and book fee:NT$6 per day per person.
    • Urine screening material fee:NT$200 per person per time.
    • Technical training material fee:NT$11 per day per person.( Those who do not take the course will be exempted)
    • Drug material fee:NT$10 per day per person.
    • Other: Based on actual demand expenditures.
  • Circumstances in which abstention compulsory abstention fees are exempt:
    • Surrender:According to the content of the ruling.

Q 14-6、The new inmates were found to have a drug reaction. What will happen?

A:According to the urine testing method of specific personnel, the correctional agency will conduct urine testing on the inmates. If the drug is positive, it will make a transcript of the conversation to understand the reason, and then send the urine to a urine testing agency for drug abuse approved by the Ministry of Health and Welfare confirmation inspection. If it is confirmed that the test result is still positive, it will be sent to the judicial organ for investigation.
