Q 9-1、How inmates go home for the funeral when relatives death?

A:

  • condition:When the grandparents, parents, spouse’s parents, spouse, children, or siblings of the inmate dies, they must be approved for a home visit by the chief of the agency and return within 24 hours. During the period outside, the sentence shall be calculated.
  • If the inmate needs to return home for the funeral, the inmate or his relatives and friends should fill in the application form and attach the following documents:
    • Death Certificate.( Household Registration Cancellation Transcript)
    • Obituary or relevant document to prove the date and place of the funeral.
    • Relevant document to prove the relationship between the inmate and the deceased.( household certificate, household registration transcript)
  • Application period:From the date of death to 2 days before the funeral.

Q 9-2、How to apply for home visits when relatives of inmates are critically ill?

A:

  • condition:When the grandparents, parents, spouse’s parents, spouse, children, or siblings of the inmate are critically ill, they must be approved for a home visit by the chief of the agency and return within 24 hours. During the period outside, the sentence shall be calculated.
  • If the inmate needs to return home for home visit, the inmate or his relatives and friends should fill in the application form and attach the following documents:
    • Medical certificate prescribed by the medical institution.
    • The critical illness notice prescribed by the medical institution within the last three days or other documents to prove the critical illness.
    • Relevant documents to prove the relationship between the inmate and the relatives.( household certificate, household registration transcript)
  • Application period:Within 3 days of the critical illness notice and other documents issued by the medical institution.

Q 9-3、How to apply for home visits when relatives of inmates suffer major harm due to disasters?

A:

  • condition:When the grandparents, parents, spouse’s parents, spouse, children, or siblings of the inmate suffer major harm due to disasters, they must be approved for a home visit by the chief of the agency and return within 24 hours. During the period outside, the sentence shall be calculated.
  • If the inmate needs to return home for home visit, the inmate or his relatives and friends should fill in the application form and attach the following documents:
    • Medical certificate prescribed by the medical institution or other documents to prove a major injury.
    • Documents to prove the relatives suffered from the disasters listed in Article 2 Paragraph 1 of the Disaster Prevention and Rescue Act
    • Relevant documents to prove the relationship between the inmate and the relatives. ( household certificate, household registration transcript)
  • Application period:Within 30 days after the disaster.

Q 9-4、Do I have to submit the application documents for home visits in person?

A:

When relatives and friends of inmates apply for home visits, they can send relevant documents by fax, the Internet, or other methods.

Q 9-5、Can the relatives and friends of the inmate decide the date of the home visit?

A:

After the correctional agency approves the application for home visits, it will arrange for a date as soon as possible. The date of the return home visit cannot be determined by the inmate’s relatives and friends. In principle, the agency will still be completed before the funeral.

Q 9-6、Can the relatives and friends of the inmate be notified in advance of the home visit date?

A:

Due to guarding safety considerations, the date and time of home visit cannot be notified in advance to relatives of the inmate. The agency will notify the relatives of the inmate before they arrive at the visiting location.

Q 9-7、Are the transportation and related expenses for home visits borne by the inmate?

A:

The transportation and related expenses for home visits should be borne by the inmate. Methods include deduction from the custody of the host, or payment by relatives and friends.
