Q 7-1、What is the purpose of the relatives survey form? Will the content of the form affect the inmates?

A:

In order to understand the status of the inmates, the correctional agency will send a " relatives survey form " to understand the health, family situation, etc., as a reference for individual treatment. The content of the form will not adversely affect the inmates.

Q 7-2、Can the inmate smoke? What are the relevant regulations?

A:

  • Agency prohibits smoking for pregnant women and those under 18 years of age. Or inmates who are not allowed to smoke by the Tobacco Hazards Prevention Act, Law of Execution in Prison, or other regulations. Inmates who do not have the above-mentioned circumstances may smoke at the time and place designated by the agency, up to 10 cigarettes per day.
  • Although the correctional agency allows the inmates to smoke, smoking is harmful to health. Based on the responsibilities of education, the inmates should still be provided with smoking prevention and control, health education, and publicity. The inmates should be actively encouraged to quit smoking.
  • Tobacco products should be purchased by the agency, and not be brought in by outsiders or themselves. The brand and quantity agency may restrict.
  • Pregnant inmates or those who have been investigated as non-smokers shall not purchase cigarettes. For inmates without the above circumstances, the purchase of cigarettes shall be based on the principle of 5 packs in two weeks, and the purchase amount shall be deducted from the custody or labor money.

Q 7-3、The inmate enters the correctional agency and there is no child or relative to take care of. How can I seek assistance?

A:

A:

  • According to the law of Execution in Prison and Detention Act, the prison (detention center) may allow the woman who enters the prison (center) and requests to bring children under three years old. Among them, if a woman with a remaining sentence of more than two months requests to bring a child under three years old, the prison must notify relevant information to the social welfare authority in the place where the child is registered for evaluation. If the social welfare authority assesses that it is in the best interests of the child, the prison may allow it. Children stay in prison with their mother until they reach the age of three. However, as assessed by the social welfare authority, those who believe that children in prison are in the best interests, children can stay until reach the age of three and six months at most.
  • Inmates should bring their own food, clothing, and necessary supplies for their children;Those who cannot provide for themselves shall be given by the correctional agency.
  • The Department and private companies promote the "Cooperation plan of strengthening the correctional agencies treatment of bringing children in prison ". Assist agencies to make improvements, refer to the relevant regulations of the establishment of child welfare institutions, and take inventory of the nursery room space and facilities.

Q 7-5、What should a vegetarian person do after entering the correctional agency?

A:

If the inmate needs to be vegetarian because of nationality or religious beliefs, he can explain the reason to the agency and submit an application. After approval, the agency’s kitchen site will provide vegetarian food.

Q 7-6、How to hire a lawyer to file a lawsuit if the inmate has no money?

A:

  • You can ask the Legal Aid Foundation to provide assistance.
  • The Foundation 's assistance:
    • Legal advice (On-site interview, telephone, video method).
    • Litigation
    • Writing legal pleadings.
    • Assist in the mediation of legal disputes.
  • Eligibility for application:

Economic status (property, income) is below a certain amount (need to meet the inability of the foundation standard).

  • Circumstances when applying for legal advice without reviewing the financial:

    • If it is a low-income household, middle-low-income household, or a family in hardship, please bring the current year's certification documents.
    • If there is no proof of point (C), please bring the "Property Ownership Information List" and " Individual Income Tax Information List of the Last Year" for the entire household( Including applicants, parents, spouses, children, and other relatives living together).     • Litigation related materials.
  • Notification of application result:After the branch accepts it, the review will be completed within 3 to 5 working days and a notice will be sent. If you are not satisfied with the review result, you can apply for a reconsideration within 30 days after receiving the notice.
  • In principle, the number of cases allowed for one year is limited to "three".
  • Pass application fee as follow:
    • When the foundation grants "full assistance", there is no need to pay attorney fees.
    • Because the applicant’s financial situation is slightly better, when the review committee decides to "partially assist", he will bear part of the lawyer and litigation-related expenses.
    • During or after the case is over, when there is a need to pay litigation-related expenses (court cost, daily travel expenses for witnesses, appraisal cost, government fees, etc.), you can apply to the foundation for payment.

Q 7-7、Will agency supply hot water for bathing in the correctional agency?

A:

During the winter period (from December 1st to the end of February), the correctional agency will provide hot water for inmate bath (provide all year to adolescents, women, inmates over 65, and patients). In other periods (March 1 to November 30), it will be provided twice a week, or when it is below 20 degrees Celsius.

Q 7-8、Can I watch TV or listen to the radio in the correctional agency?

A:

  • Personal radio, television, or audio-visual equipment approved by the prison or detention center is allowed to listen to and watch.
  • The radio can only be possessed by inmates at Level 3.

Q 7-9、After entering the correctional agency, how many people use the ward? Will water or electricity be restricted?

A:

  • Depends on the size of the ward.
  • All agencies have regulations on water, electric fans, and lighting time.
  • Ceiling fans, exhaust fans, or other equipment are currently installed in the ward to promote ventilation. Water is supplied regularly, and there are water storage buckets in the ward.

Q 7-10、Is the toilet squatting or sitting? Will there be a shelter?

A:

The toilets are mainly squatting, but some of the wards are equipped with sitting toilets for the elderly, the weak, the sick, or the people with limited mobility. In addition, the toilets are equipped with shelters.

Q 7-11、What is the daily life of the inmates?

A:

  • Correctional agencies provide operation, edification and education, rations, Sanitation and Health, and medical treatment. The daily life of the inmate is scheduled according to the above items.
  • The inmates live a regular life in the agency. Outside of normal exercise, meals, and breaks, the agency will arrange courses such as operation, edification and education, coaching, cultural activities, or vocational training. During the holidays, the inmates will do activities in the ward, such as tidying up, reading, watching TV, and listening to music.
  • If the defendant did not participate in the operation, in addition to appearing in court, exercising, seeing a doctor, and visit, he spent the rest of the time in the ward reading, writing letters or pleadings, listening to the radio, or watching TV.

Q 7-12、Will I be bullied in a correctional agency? What should I do if I am bullied?

A:

  • Bullying is strictly prohibited in the agency. If bullying occurs, the agency will punish the perpetrators by regulations, and provide counseling to the victims.
  • If the inmate is bullied, he can report to the controller or the suggestion box. After receiving the information, the controller will understand, and if the statement is true, it will be handled by regulations.

A:
